ARKADIANS Project Set to Launch After Court Clearance

KARACHI: The long-delayed ARKADIANS project is finally set to launch after the Sindh High Court (SHC) and the Supreme Court of Pakistan dismissed multiple petitions and claims against it, clearing the way for its development.

Defense Housing Authority (DHA) claimed before the court, “it is not an amenity plot.” In the final 2007 master plan, the site was approved for the ARKADIANS project.

The DHA, who was also a defendant No 1 in the suite, denied the alleged claims of the plaintiff and said that the master layout plan produced by the plaintiff before this court is fake and unapproved document.

Since 2013, a series of legal challenges were filed by different plaintiffs, including prominent business figures, questioning the legality of the project. However, both courts rejected these claims due to lack of evidence or failure to pursue them.

Located in DHA Phase 8, Karachi, facing the Golf Club and Defence Creek seaside, the ARKADIANS project spans 43 acres and includes 13 residential towers, office enclaves, and utility spaces. Its prime location and scale set it apart from other real estate projects across the city.

The plaintiffs had argued that the land was an amenity plot originally reserved for a park, graveyard, schools, and sewerage treatment facilities. However, the Sindh High Court categorically ruled: “It is not an amenity plot.”

The Defense Housing Authority (DHA), a key defendant in the case, denied all allegations, stating that the layout plan produced by the plaintiffs was fake and unapproved. DHA maintained that:

In the 1989 plan, the site was only tentatively marked for future use.

In the 1992 plan, it was provisionally earmarked for projects “Creek Views” and “Creek Terrace.”

In the final 2007 master plan, the site was approved for the ARKADIANS project, confirming it was not an amenity plot.

The plaintiffs also failed to prove their allegation that the project was awarded unlawfully. According to DHA, the project was entrusted to a developers’ consortium, formed under a memorandum of understanding dated February 17, 2005, followed by an agreement on July 10, 2006, which led to the incorporation of the developer company.

With legal hurdles now removed, the ARKADIANS project is set to move forward, marking a significant addition to Karachi’s real estate landscape.
