SHC restrains Creek Marina to sell apartments
1 min readKARACHI: Sindh High Court has restrained Creek Marina Singapor and Creek Marina from advertising, promoting or offering further apartments or projects in the reclaimed lands or create any third party interest therein till next date of hearing.
The interim order came on lawsuit of Siddiq sons and others against defendants over non-completion of the project.
Plaintiff counsel Haider Waheed submitted that plaintiffs were handed out 24 apartments in Creek Marina project in term of settlement agreement. He referred court order in respect of another project in which court had restrained the private builder Emmar Giga from advertising, promoting or offering any further apartments or project on the reclaimed lands or creating any third party interest therein.
Plaintiffs’ counsel submitted that his clients have identical nature of the case as apartments handed out to the plaintiff pursuant to the settlement agreement are identically placed as those are not eve in existence and requested the court similar orders in the case.
The court after preliminary hearing of the case issued notices to DHA, Karachi Port Trust, Clifton Cantonment Board, Creek Marina and others and called their comments on July 21.
The court in meantime restrained Creek Marina Singapore, Creek Marina and others from advertising, promoting or offering any further apartments or projects in the reclaimed lands or create any third party interest therein till next date of hearing.
